Terms of Service

These Terms of Service ("Terms") govern your use of DartChat ("Service"), operated by Vector & Verse ("we," "us," or "our"), located in Murrieta, CA. By accessing or using DartChat, you agree to be bound by these Terms.

1. Description of Service

DartChat is an AI-powered SMS automation middleware for GoHighLevel. The Service sends automated text message responses to inbound leads on behalf of businesses using the GoHighLevel platform.

2. Eligibility

You must be at least 18 years old and authorized to operate a business to use DartChat. By using the Service, you represent that you meet these requirements.

3. Acceptable Use

You agree to use DartChat only for lawful business communication. You may not use the Service to:

• Send spam, unsolicited messages, or messages that violate the TCPA or applicable federal and state laws
• Impersonate any person or entity
• Transmit harmful, abusive, or illegal content
• Resell or redistribute the Service without written permission

4. SMS Messaging Compliance

You are solely responsible for ensuring your use of DartChat complies with all applicable SMS regulations, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and 10DLC registration requirements. You must obtain proper consent from all contacts before sending automated messages through the Service.

5. Subscription and Billing

DartChat is offered on a flat-rate monthly subscription basis. Fees are billed in advance and are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind, express or implied. We are not liable for any downtime, data loss, or damages arising from your use of the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your business data. We do not sell your data to third parties.

8. Termination

Either party may terminate the subscription at any time. Upon termination, your access will end at the close of the current billing period. We may terminate immediately if you violate these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, Vector & Verse shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of DartChat. Our total liability shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Service after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.
